Terms of use

These Terms of Use govern the process of submitting comments online in relation to collecting feedback or consultation processes or sharing files in the frame of a committee, project or as otherwise you collaborate with CyADA.

Use of Platform – CyADAConnect

Making comments on the part of the CyADA website dedicated to CyADA consultations ([the “Platform- CyADAConnect”]) and/or sharing files through the “Platform CyADAConnect” in the frame of a committee, project or as otherwise you collaborate with CyADA is subject to these Terms of Use.

By using the Platform- CyADAConnect and registering your details (full name, email and password), you accept, without limitation or qualification, these Terms of Use and you acknowledge that you have read, understood and agree to these Terms of Use.

If you do not agree to these Terms of Use, you may not use the Platform CyADAConnect.

CyADA may modify these Terms of Use at any time, at its discretion and without notice, and modifications are effective upon being posted on the CyADA website. Nevertheless, all registered users of the Platform CyADAConnect will be notified by e-mail should the Terms of Use are modified.

You are responsible for reviewing these Terms of Use periodically to ensure that you are fully informed of any changes to them.

User Account, Password and Security

In order to use the Platform CyADAConnect, you must provide us with your full name and a valid e-mail address.

Once you are granted access privileges to CyADAConnect, you will be entirely responsible for maintaining the confidentiality of your password and account, and for taking reasonable precautions to prevent the inadvertent disclosure of your password or account information, including not sharing login information with anyone else. We advise you to change your password after login on the first time with your registered password given by CyADAConnect.

Furthermore, you are entirely responsible for any and all activities that occur under your account.

You agree to notify CyADA immediately of any unauthorized use of your account or any other breach of security.

CyADA will not be liable for any loss that you may incur as a result of someone else using your password or account, either with or without your knowledge.

You may be held liable for any harm or loss (including legal fees related to same) incurred by CyADA or another party due to someone else using your password or account.

CyADA may suspend or terminate your access to the Platform- CyADAConnect if CyADA believes your account is being used by an unauthorized person or if you have not complied with these Terms of Use or for any other reason in CyADA’s sole discretion.

You may not use anyone else's account at any time, without the express permission of the account holder.

CyADA’s use of comments that you submit

If you are submitting a comment online in the frame of a consultation process, you agree that all comments made will be considered non-confidential and non-proprietary unless CyADA states otherwise. Nevertheless, if you would prefer that your comments remain confidential or to be used anonymously, please contact CyADA at [email protected] to make your wishes known. We will seek to comply with such requests.

Use of shared files

Any non-public information that is shared by CyADA through the Platform CyADAConnect in the frame of a consultation process, as well as any non-public information that is shared through the Platform CyADAConnect by CyADA or you in the frame of a committee, project or as otherwise you collaborate with CyADA, shall remain confidential and not be disclosed to any third party, unless expressly authorized by CyADA.

It is meant that, breach of your obligation of confidentiality may result in possible legal action against you and, if applicable, the immediate termination of your engagement with CyADA.

File retention

A file retention policy has been set for every topic meaning that all files stored on the platform will be automatically deleted 30 days after they are uploaded or as otherwise advised by CyADA.

Acceptable Use

You agree to refrain from posting any comments that:

• violates any laws or legal rights of other persons or entities;
• infringes upon the copyright, trademark, or other intellectual property of others;
• breaches any legal duty owed to a third party, such as a contractual duty or a duty of confidence;
• is obscene, offensive, discriminatory, hateful or inflammatory;
• is abusive or prejudiced contains knowingly false statements, libel, or slander; or
• contains spam or unwanted commercial solicitations.

Indemnification and disclaimer

You are solely responsible for the comments you post or the files you share here.

CyADA may remove comments or files at any time if, in our sole opinion, they are not relevant to the topic, respectful of others, compliant with our acceptable use standards, or otherwise not suitable for the consultation process or the work of the committee, project or as otherwise you collaborate with CyADA.

CyADA does not vouch for or warrant the accuracy or usefulness of any information posted, nor is responsible, or liable to any third party, for the contents of any message posted by you or any other user of the Platform CyADAConnect. The comments express the views of the author of the message and do not reflect CyADA opinions.
